Drugs and Alcohol Act

Section 1

This law shall be cited as the Drugs and Alcohol Act.

Section 2

The purpose of this Act is to regulate the possession, distribution, and consumption of intoxicating and controlled substances within the Territory of Bearland in order to preserve public health, maintain social order, and ensure responsible, safe, and lawful use where permitted.

Section 3

For the purposes of this Act, the following terms shall apply:

a. “Alcohol” means any beverage intended for human consumption containing an ethanol content greater than 0.5% by volume.

b. “Controlled substance” means any drug, chemical, or compound classified as restricted or prohibited under Section 5 of this Act.

c. “Public place” means any area accessible to the general population, whether indoors or outdoors, regardless of ownership status.

d. “Possession” includes physical possession or constructive possession where an individual has knowledge of and control over a substance.

e. “Legal substance” means any medication, supplement, product, or non-prescription item not classified as Prohibited or Restricted under Section 5 and is lawfully obtainable through retail, pharmacy, or medical service.

Section 4

a. Alcohol may only be possessed or consumed by individuals 21 years of age or older.

b. Responsible consumption of alcohol in public places is permitted; however, individuals shall not be:

  1. Visibly or dangerously intoxicated,
  2. Disorderly, aggressive, or disruptive,
  3. Endangering themselves or others, or
  4. Causing a public nuisance.

c. No person shall operate vehicles, machinery, aircraft, watercraft, or perform hazardous, safety-critical, or public-risk duties while impaired beyond 0.06% BAC, or while otherwise demonstrably unable to operate safely.

d. No person shall operate vehicles, machinery, aircraft, watercraft, or perform hazardous, safety-critical, or public-risk duties while under the influence of cannabis or any other psychoactive or impairing substance, regardless of quantity consumed, active effects, tolerance, or perceived level of impairment. This restriction applies to all substances except nicotine and non-impairing medications or supplements that are lawfully prescribed or appropriately used according to medical or manufacturer directions, and which do not negatively affect alertness, judgment, coordination, or reaction capability.

Section 5

All controlled substances within the Territory of Bearland shall fall into one of the following categories: Prohibited, Restricted, or Fully Legal.

a. PROHIBITED SUBSTANCES

The following substances are classified as Prohibited and may not be possessed, consumed, manufactured, sold, gifted, transported, imported, or distributed for any reason, except where separately and explicitly authorized under Section 5(b).

1. Hard Narcotics, Street Opiates, and Illicit Opioids

  • Heroin (diacetylmorphine)
  • Fentanyl when not medically dispensed
  • Fentanyl analogs
  • Carfentanil
  • Opium intended for recreational use
  • Oxycodone, hydrocodone, morphine, codeine, and hydromorphone when possessed without medical authorization
  • Lean

2. Illicit Stimulants & Amphetamine Analog Drugs

  • Methamphetamine
  • Cocaine
  • Coca paste / base
  • MDPV, α-PVP, α-PHP, 4-MMC, Mephedrone, Methylone, Butylone, Pentylone
  • Synthetic cathinones (Bath Salts)
  • Illicit “research stimulants” including Etizolam-based stimulants
  • All methylenedioxy-substituted amphetamines, including MDMA, MDA, MDEA, MBDB
  • Any structural or functional analog intended for psychoactive use

3. Illicit Dissociatives, Deliriants, & Hallucinogens

  • PCP
  • Non-medical ketamine, ketamine obtained illicitly, or ketamine used without medical supervision
  • NBOMe family compounds (25I-NBOMe, 25B-NBOMe, 25C-NBOMe, etc.)
  • DOx series when illicit (DOM, DOB, DOC)
  • Lysergamide analogs not medically supervised, including LSZ, AL-LAD, ETH-LAD, and similar
  • Unregulated psychedelic RCs including 5-MeO-AMT, 4-AcO-DMT, 5-MeO-DALT obtained illicitly

4. Synthetic, Laboratory-Altered, or “Designer” Intoxicants

  • Any structural analog designed to imitate or replace a prohibited substance
  • All substances marketed as “legal highs,” “not for human consumption,” “research compounds,” “novel psychoactives,” or similar
  • Products intentionally mislabeled to bypass regulation, including spice / K2 containing synthetic cannabinoids such as:
    • JWH-018, AM-2201, UR-144, XLR-11, AB-FUBINACA, MDMB-CHMICA, ADB-BUTINACA, 5F-PB-22

5. Inhalant Abuse Chemicals

The listed materials are only prohibited when used for intoxication.

  • Spray paint
  • Industrial glue / adhesives
  • Solvents, gasoline, kerosene, lighter fluid
  • Aerosol propellants
  • Keyboard cleaner / canned air
  • Butane / propane for recreational inhalation

6. Pharmaceutical Abuse Beyond Medical Limits

  • Dextromethorphan (DXM) consumed in mega-dose recreational quantities
  • Diphenhydramine when consumed in high-dose or recreational quantities intended to cause sedation, hallucination, dissociation, or delirium
  • Nitrous oxide used outside medical or culinary use
  • Any prescription drug taken without prescription, for intoxication, or in non-therapeutic dosage

The following substances are additionally classified as Prohibited unless reclassified: Kratom, DMT and ayahuasca preparations, LSD, Peyote, Salvia Divinorum, Mescaline, GHB, GBL, 1,4-Butanediol (1,4-BD), Rohypnol (Flunitrazepam), Gamma-Valerolactone (GVL), Scopolamine (including Burundanga-type preparations), Nitazene-class synthetic opioids, Krokodil (Desomorphine), unlicensed benzodiazepine analogs including but not limited to Etizolam, Flubromazolam, Clonazolam, Diclazepam, and Nitrazolam. Any agent, analog, precursor, or chemical deliberately used, intended, marketed, or modified for incapacitation, memory impairment, or non-consensual administration.

Any substance administered to another person without their voluntary, informed, and conscious consent, regardless of its legal status, scheduling, intended purpose, dosage, method of delivery, or resulting effect, shall be treated as a Prohibited Substance under this Act. A person who is subjected to the non-consensual administration, ingestion, inhalation, absorption, or injection of any substance shall not be criminally or civilly liable for possession, use, consumption, impairment, or any resulting condition related to that substance. Any individual who administers, attempts to administer, prepares to administer, conspires to administer, assists in administering, or otherwise facilitates the non-consensual administration of any substance shall be fully criminally liable and may be charged with a separate offense in addition to any other applicable violations, regardless of whether physical harm, incapacitation, intoxication, or measurable effect occurs.

CA Clause

Any compound, mixture, or chemical, natural, synthetic, or altered, which is reasonably intended, marketed, or used for psychoactive intoxication, and not legally approved or medically supervised, shall be treated as a Prohibited Substance, regardless of naming, branding, or origin.

b. RESTRICTED SUBSTANCES (Prescription-Only / Licensed Use)

Restricted substances can include prohibited substances, but may only be possessed or used with written authorization, prescription, or clinical approval.

Includes but is not limited to:

  1. Opioid pain medications
    • Morphine, hydrocodone, oxycodone, hydromorphone, codeine, tramadol
    • Buprenorphine & methadone (addiction treatment)
  2. Benzodiazepines & hypnotics
    • Alprazolam, clonazepam, lorazepam
    • Diazepam, midazolam
    • Z-class sleep drugs (zolpidem, eszopiclone)
  3. Prescription stimulants
    • Amphetamine salts (Adderall)
    • Methylphenidate / dexmethylphenidate (Ritalin, Focalin)
    • Modafinil & armodafinil
  4. Anti-psychotic & psychiatric medications
    • Quetiapine, risperidone, olanzapine, lithium, etc.
  5. Ketamine (when clinically supervised)
  6. Local or general anesthetics
  7. Anabolic and androgenic performance-enhancing steroids (AAS)
  8. Selective Androgen Receptor Modulators (SARMs)

c. FULLY LEGAL SUBSTANCES

The substances listed below are considered legal within Bearland. This list is not exhaustive, and any substance not classified as Prohibited or Restricted under Section 5 shall be considered legal by default, unless later regulated by law.

  1. Nicotine & tobacco products (age 21+)
  2. Alcohol (age 21+)
  3. Cannabis (age 21+)

Section 6

a. Authorized enforcement officials may seize substances found in violation of this Act.

b. Seized materials shall be cataloged and safely destroyed under government procedure.

Section 7

Any violation of this Act may be prosecuted as a criminal offense within Bearland. Offenses may be classified anywhere from Class E to Class X, depending on severity, substance, intent, and circumstances.
